Teisiniai iššūkiai įgyvendinant Jungtinių Tautų Žmogaus teisių komiteto išvadą byloje Jagminas prieš Lietuvą
Abstract
The article analyses a decision of the Supreme Administrative Court of Lithuania
(SACL) of 11 May 2021, whereby the SACL reconsidered its decision in G. Jagminas’ case after the
United Nations (hereafter – UN) Human Rights Committee concluded that Lithuania breached its
obligations under Article 25(c) of the International Covenant on Civil and Political Rights (hereafter
- ICCPR)(right to equal access to state service). The decision to reopen proceedings in G. Jagminas’
case was possible because of an amendment of Article 156 of the Law on Administrative Proceedings,
which specified that this procedural step was possible not only after a finding of a breach of the
European Convention on Human Rights, but also when the UN Human Rights Committee presents
its views finding a breach of the ICCPR.
The article discusses the questionable aspects of the decision of 12 May 2021, which, arguably,
might be qualified as a separate breach of the right to a fair trial.
