Abstract

The authors of the article emphasize the influence of the EU law to the environmental law of the Republic of Lithuania – i.e. the influence of EU environmental law principles and EU environmental regulation. There are evident problems of correct transposition of the EU law provisions into the national legal system of Lithuania and the problem of insufficient society information level in respect of the environmental requirements set by the EU. The problematical situation of the EU law influence to Lithuanian environmental law may be described in three ways: firstly, EU environmental law and international environmental law integrity and double influence to Lithuanian environmental law; secondly, the adjustment and harmonization with the EU law of the Lithuanian legislation in separate fields of environment; thirdly, insufficient information of Lithuanian society in the field of the environmental requirements set by the EU and as a consequence an incomparably lower level of correct EU law transposition, application and implementation in Lithuania. The article “Waste management regulation within the European Union as one of the aspects of the right to healthy environment implementation“ includes the analysis of the quality of the transposition of the Directive on Waste into the national legal system of the Republic of Lithuania. Having carried out the analysis of the transposition of this directive the authors have come to the conclusion that overall the directive is transposed correctly, containing no serious breaches of the EU law. However, there is a lack of understanding within the authorities of the Republic of Lithuania that the most important EU directives, covering a wide range of theoretical norms (as in the case with the general directive on waste), should be transposed into one major specialized act instead of many acts of lower and higher legal obligation. The agreement to such a recommendation would eventually help to make the EU law principles easily known as all the necessary norms and principles could be found within one major act covering the basic principles and requirements.
