The increase in illegal drugs delivery and consumption in Lithuania and inefficency of the legal and other counter- measures aimed to combat this trends bring the necessaty of the radical review of the whole drug control system. The first step in this direction should be the specification of the Lithuanian criminal law provisions persecuting drug delivery and consumption. This specification should be started with the revision of the place of counter drug provisions among other provisions of the Special part of the Criminal Code. The most important is to review the common good that supposed to be protected by this provision. All counter-drugs provisions have to be consolidated in a single section of Criminal law supposed to protect the most basic social goods – one‘s life and health. This will bring the legal assessment of this provision in conformity with the real importance of the social good that is protected by it. This, next, provides further opportunities for the best formulation of anti-drug provisions and one‘s responsibility for their violation.
