Abstract

The article discusses ways of new regulation of evidence gathering in the new Code of Criminal Procedure of the Republic of Lithuania. It is proposed to divide the ways of evidence gathering as follows: questioning, observation, technical ways of obtaining physical evidence and documents and scientific ways. According to the chosen ways of evidence gathering (he competence of subjects of evidence gathering process has to be defined. The new procedural figure -judges of pre-trial case investigation - has to be introduced in Lithuania. A specialist has to cany out the investigation of crime scene and an expert witness has to take part at a trial. The main differences of legal status of a specialist and an expert are also described in the article.
