dc.description.abstractDuring the 40 years of existence of European Community plenty of policies were harmonised, however, there are still a lot of blank areas to be unified. Until recently involvement of employees in the affairs of enterprise was one of the field impossible to harmonise due to vast differences in national legislation and practices and strong resistance of the Member States. In 1994 the so-called European Works Council directive, followed by the Council directive supplementing the Statute for a European company with regard to the involvement of employees in 2001 and European Parliament and Council directive establishing a general framework of informing and consulting employees in the EC in 2002 created the European system of involvement of employees in the affairs of enterprise. The system would be clear if to add other important legislation in the field – Council Directive 2003/72/EC supplementing the Statute for a European Cooperative Society with regard to the involvement of employees, Council Directive 98/59/EC on the approximation of the laws of the Member States relating to collective redundancies and Council Directive 2001/23/EC on the approximation of the laws of the Member States relating to the safeguarding of employees' rights in the event of transfers of undertakings, businesses or parts of undertakings or businesses. This system comprises of information and consultation procedures in Community-scale undertakings and Community-scale groups of undertakings, the information and consultation requirements applied to national enterprises that employ certain number of employees, consultation, information and participation in European company and European Cooperative Society and information and consultation procedures under certain circumstances (collective redundancies and transfer of undertakings, businesses or parts of undertakings or businesses. This work aims at analysing European system of involvement of employees in the affairs of enterprise providing an in depth analysis of concepts of involvement of employees in the affairs of enterprise. The author concludes that involvement of employees in the affairs of enterprise comprises of three stages, namely information, consultation and participation. The article analyses the model of employee participation to be applied in Lithuania following new labour laws, including Labour Code that entered into force on 1 January 2003.en

dc.description.abstract-ltŠiame straipsnyje, kurio pagrindiniai aspektai buvo aptarti pranešime, skaitytame 2002 m. mokslinėje konferencijoje, nagrinė-jami pastaruoju metu ypač svarbūs nacionalinės teisės suderinimo su Europos Bendrijos teise darbuotojų dalyvavimo valdant įmonę klausimai, pateikiamos pagrindinės šio instituto sąvokos. Straipsnyje apžvelgiama darbuotojų dalyvavimo valdant įmonę derinimo Europos Bendrijos teisėje raida, atskleidžiama Europos Bendrijoje taikoma darbuotojų dalyvavimo valdant įmonę sistema. Straipsnyje analizuojamos pagrindinės Lietuvos teisėje įtvirtinto darbuotojų dalyvavimo valdant įmonę instituto derinimo su Europos Bendrijos teise problemos, pateikiami pasiūlymai, kaip tobulinti Lietuvos teisę. Šio straipsnio tikslas – pateikti darbuotojų dalyvavimo valdant įmonę sąvoką, ištirti šio instituto taikymą Europos Bendrijos ir Lietuvos teisėje bei atskleisti pagrindinius Lietuvos teisės derinimo su Europos Bendrijos teise trūkumus. Pagrindinis tyrimo objektas – nacionalinės ir EB įmonių ir darbo teisės aktai, reguliuojantys darbuotojų dalyvavimą valdant įmonę. Nagrinėjant pasirinktą tyrimo objektą, taikyti pagrindiniai teisės mokslo tyrimo metodai: loginis-analitinis, sisteminis, lyginamasis ir kiti.en
