Apie Steigiamojo seimo konstitucinės kūrybos pritaikymą išsivaduosiančiai Lietuvai: išeivijos požiūris (1945–1990)
Abstract
The article describes the main publications of emigrant press during the period of 1945-1990. These publications reflect a significant contribution to the academic research of the constitutional development problematics of an independent Republic of Lithuania in 1918-1940, made by the emigrants who escaped Soviet aggression by going to the West. Among emigrants these topics were mostly analysed and described at the time when any possibilities of objective academic research in Lithuania were widely limited by Soviet ideology and politics. Exceptional attention of emigrant authors was attracted by the democratic constitutional structure of Lithuania, established by the Constituent Assembly. The article describes the academic research made by emigrants on the main constitutional acts established by the Constituent Assembly, such as the resolution of the 15th of May, 1920, ascertaining the fact of reconstructing the independence of the state of Lithuania, as well as the Constitution of Lithuania of August the 1st, 1922.
The emigrants’ interest on the constitutional problematics of an independent Lithuanian state were determined not only by their academic interests, acquaintance with the whole situation and emotional connection with their lost motherland, but also with future perspective hoping that their ideas in showing the possible ways and means for improving the constitutions, especially in the sphere of the power balance of the legislature and executive power, by increasing the stability of the Seimas, could have been very helpful to the state that was going to be independent after all. All the ideas of the emigrants, concerning the constitutional structure of an independent state of Lithuania mostly conformed with the actual provisions of the constitution legislator of Lithuania, a country with repeatedly restored independence. In the present constitutional practice of the Republic of Lithuania, the significant part of means suggested and specific reasoning given by the emigrant authors is reflected.
