Abstract
Analizuojant iš tarpkultūrinės komunikacijos prielaidų išplaukiančius tam tikrus paprotinės teisės niuansus, remiamasi pagrindiniu šaltiniu A. Antonovičiaus monografija Baltarusiški tekstai, užrašyti arabiškais rašmenimis, ir jų grafinė-ortografinė sistema, pasitelkiant kalbininkų, sociologų, kultūros istorikų nuomonę ir įvairių reiškinių interpretaciją. Kadangi į aptariamąjį lauką patenka net kelių panašią istorinę patirtį turinčių kalbų – baltarusių ir lenkų – komunikavimo aspektai, juos galima vertinti nevienodai: viena vertus, jie neabejotinai pozityvūs, amžių sandūroje praplėtę Lietuvos kultūrinį horizontą, praturtinę kalbiniu požiūriu ir net literatūrinių įvaizdžių prasme tautinę tapatybę; kita vertus, dėl nepalankių politinių ar istorinių aplinkybių, nepakankamai ištirti ar išvis nežinomi, netapę istorikų analizės objektu.
Very few articles have been written about A. Antonowitz book „Byelorussian texts noted in Arabic letters and their graphic-orthographic system“, but there was issued one fundamental study by G. Miškinienė „The oldest manuscripts of the Lithuanian Tatars: graphics, transliteration, translation, structure of texts and content“. The aim of this paper is to fill in the niche in the investigation of multilingual texts, created by authors and copyists in the wide area of the present Lithuania, Polish and Belarus. The article is mostly concentrated on different aspects of customary law, but, aiming to show the wholeness and uniqueness of the manuscript heritage, intertextual aspect of the texts published in A. Antonowitz book is taken into account as well. The paper consists of introduction, two analytical parts and conclusions. The most important aspects of texts are the formation of the community custom tradition, the showing out of the most important semantic centres. The language of Byelorussian texts written in the Arabic script is very close to the people`s spoken tongue. It reflects many a typical feature of the South-West Byelorussian and Polish dialects as well as the peculiarities of a narrow belt of the Lithuanian dialects and those of the South-West part of the Polock group, directly adjoining the Lithuanian speech territory. In connection with the above considerations it should be noted that the texts in A. Antonowitz book constitute rather reliable material for studying such phenomes of the customary law as conception of goodness and evil, sense of community.
