Abstract
Šiandieną, teismo ekspertizės mokslas, ypatingai viena iš jo atliekamų veiklų: daiktinių įkalčių interpretavimas, yra nuožmiai kritikuojamas. Viena iš pagrindinių tos kritikos priežasčių yra ta, kad netgi tokie identifikacijos metodai kaip DNR ar pirštų pėdsakai šiuo metu jau nėra šimtu procentų patikimi; šis nepatikimumas yra sąlygojamas žmogiškojo faktoriaus, ryškiausiai pasireiškiančio daiktinių įrodymų interpretavimo metu. Teisėjas priimdamas galutinį nuosprendį privalo remtis pateiktais daiktiniais įrodymais, kurie teisme pristatomi remiantis ekspertų ir specialistų interpretacijos metu atliktomis išvadomis. Autorius savo straipsnyje nagrinėja interpretacijos metu daromų klaidų priežastis ir jų pasekmes, analizuoja mokslinėje literatūroje siūlomus metodus, kurių pagalba galima būtų išvengti klaidingų interpretacijų teisme ir ikiteisminiame tyrime.
Recently, forensic science, particularly interpretation of physical evidence, has been fiercely criticized. One of the main reasons of that critic is that that not anymore even such identification methods as DNR and fingerprints can be held hundred per cent trustful as their reliability depends not only on existence of real evidence but also on human’s interpretation of it. A judge is the person who has to make the final right decision in a case; however his decision has to be bolstered up with the inferences made in the process of interpretation by experts and specialists. This paper deals with the causes and effects of the mistakes made during the process of interpretation; and also it analyses the methods which might be applied in the process of justice in order to avoid interpretation faults.
